Terms


This agreement is between Musichool OÜ (hereinafter referred to as “Musichool”), located at “Põhja-Tallinna linnaosa, Paavli tn 5a/1, 10412, Harju maakond, Tallinn, Estonia”, operating on the website www.musichool.co/tr (hereinafter referred to as the “Site”), and the user who is a member of the Site or uses the Site without registering (hereinafter referred to as the “Member”). Musichool and the Member will hereinafter be jointly referred to as the “Parties.”

Subject
The subject of this Agreement is the determination of the terms under which the Member may use the Site and the electronic provision of products and services offered through the Site by Musichool to the Member.

Obligations
Musichool acknowledges and undertakes that, except for force majeure reasons, the Member will benefit from the services and products offered on the Site.

The Member agrees not to create or share content that violates public morality or the law, infringes the rights of third parties, is misleading, offensive, obscene, pornographic, violates personal rights, violates intellectual and industrial property rights, or encourages illegal activities in their activity communications on the Site. Otherwise, the Member will be solely responsible for any damages incurred, and in such cases, Musichool officials may suspend or terminate such accounts and reserve the right to initiate legal proceedings against them.

The Member acknowledges and undertakes not to copy, reproduce, or make available to third parties any materials found on the Site, especially instructors’ courses, which are protected by intellectual property rights, under any circumstances.

The Member is solely responsible for the security of the system access tools used by the Member to benefit from the products and services offered by Musichool. Musichool has no direct or indirect liability for any damages incurred or to be incurred by the Member and/or third parties due to negligence or omission on the part of the Member regarding the security of the system access tools, the storage of this information, and its protection against third parties.

The Member acknowledges, represents, and undertakes that the information and content provided by the Member on the Site are accurate and lawful. Musichool is not obligated to verify the accuracy or currency of the data provided by the Member, nor to guarantee or warrant the security and lawfulness of this information. Musichool shall not be held responsible for any damages arising from the inaccuracy or incompleteness of such information and content.

The Member may not transfer its rights and obligations under this Agreement, in whole or in part, to a third party without the written consent of Musichool.

If the Parties act in violation of this clause, the Party acting in violation agrees and undertakes to pay the other Party a penalty equal to one year’s membership fee.

Effectiveness
By the Member; By opting in to this agreement, whether by registering or not, the Member agrees to all terms and conditions of this agreement. This agreement enters into force upon the Member’s registration to the Site. If the Member continues without becoming a member, the agreement is deemed concluded by checking the box and enters into force upon their registration.

Personal Data Protection
Musichool has published a Personal Data Protection Information Text on its website to comply with personal data protection legislation. This text explains which personal information will be processed and transferred, and how it will be transferred. The Member is informed in detail about their legal rights.

By approving this agreement, the Member acknowledges and declares that they have read and understood the information regarding the processing of their personal data.

Termination of Agreement
This agreement will remain in effect until terminated by either party for any reason. Musichool may unilaterally terminate the agreement of a Member who violates any provision of this agreement.

Force Majeure
If Musichool becomes unable to fulfill its obligations arising from this Agreement due to reasons beyond the control of the Parties, such as natural disasters, fires, explosions, civil wars, wars, riots, civil commotions, declarations of mobilization, strikes, lockouts, epidemics, infrastructure and internet failures, or power outages (collectively referred to below as “Force Majeure”), Musichool is not responsible for this. During this period, the Parties’ rights and obligations arising from this Agreement are suspended.

Revision
Musichool may partially or completely change the services offered on the Site and the terms of this Agreement due to commercial interests and changes in legislative provisions. It is the Member’s responsibility to monitor any changes published on the Site.

Notification
All notifications to be sent to the parties related to this Agreement shall be sent to the Member’s
